Welcome to SwapAxe. These Terms of Service ("Terms") govern your access to and use of the SwapAxe platform, including our website, mobile applications, and related services. By creating an account or using SwapAxe, you agree to be bound by these Terms. If you do not agree, please do not use our services.

You may not create an account on behalf of someone else or transfer your account to another person without our permission. We reserve the right to suspend or terminate accounts that violate these Terms.
SwapAxe is a marketplace platform that connects people who want to rent items ("Renters") with people who have items available for rent ("Owners"). It is important to understand:

The SwapAxe name, logo, website design, and all related trademarks, service marks, and intellectual property are owned by SwapAxe and protected by applicable laws.
User Content: You retain ownership of content you create (listings, photos, reviews). By posting content on SwapAxe, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for platform operations and marketing purposes.
You may not use our intellectual property without written permission. We respect intellectual property rights and will respond to valid infringement notices.
SwapAxe is provided "as is" and "as available" without warranties of any kind,either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
SwapAxe is not liable for:
Our total liability for any claims arising from your use of SwapAxe is limited to the greater of (a) the fees you paid to SwapAxe in the 12 months preceding the claim, or (b) $100 USD.
You agree to indemnify, defend, and hold harmless SwapAxe, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the platform, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you post on SwapAxe.
You may delete your account at any time through your account settings. SwapAxe may suspend or terminate your account if:
Upon termination, your right to use SwapAxe ceases immediately. Provisions that should survive termination (liability limitations, indemnification, etc.) will remain in effect.
Between Users: We encourage users to resolve disputes directly. If you cannot reach a resolution, contact SwapAxe support within 24 hours of the rental end date. We will review evidence from both parties and make a determination, which is final and binding.
With SwapAxe: Any disputes between you and SwapAxe will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive the right to participate in class action lawsuits or class-wide arbitration.
Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
SwapAxe reserves the right to modify these Terms at any time. We will notify users of material changes via email or platform notification at least 30 days before they take effect. Your continued use of SwapAxe after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using SwapAxe and delete your account.

These Rental Policies govern all rental transactions conducted through SwapAxe. Both Renters and Owners are required to understand and comply with these policies. Violation of these policies may result in cancellation of bookings, account restrictions, or termination.

Returning items late has the following consequences:
Communication is key: If you anticipate being late, contact the Owner immediately. Many Owners are willing to accommodate reasonable delays if notified in advance.
Repeated late returns (3 or more) may result in account restrictions, including loss of ability to make instant bookings.
Minor wear from proper, intended use is expected and will not result in charges. Examples include light scratches on tools from normal use, slight dust accumulation, or minor cosmetic wear.
Renters are responsible for damage beyond normal wear and tear. This includes broken parts, significant scratches or dents, water damage, or damage caused by misuse. Charges are based on actual repair costs or proportional replacement value.
Renters are responsible for the full replacement value of items that are lost, stolen, or damaged beyond repair during the rental period. We recommend Renters check their personal insurance policies for coverage.
Owners must report and document any damage within 24 hours of the item's return using the "Report Issue" feature. Include clear photos and descriptions of the damage. Late reports may not be eligible for damage claims.
If there is a disagreement about damage, SwapAxe will review the mandatory handoff and pickup photos, conversation history, and any additional evidence from both parties. SwapAxe facilitates the resolution process but does not assume financial responsibility for damages — liability rests with the parties involved in the rental.
The following items may not be listed or rented on SwapAxe:
Listing prohibited items will result in immediate removal of the listing and may lead to account suspension or termination.
